Currently I carry my Bersa 380 in my car right between my seat and my console. (See pics) I do have a CCP and usually have another bug on my person. However, I like to keep my Bersa where I can get to it ASAP if needed. (To avoid a carjacking or whatever) But it's not exactly concealed... Is this legal? I really don't want to be breaking any laws. I couldn't find anything pertaining to this issue. BTW, I live in Florida if that matters.

That would be legal in New Mexico, but not in other states. I don't know about Florida, I would suggest consulting your local constabularies, as many as possible. Ask at your local gun shop, etc...

I say ask numerous policeman because I have known many an offcer that didn't know the law themselves, so a large sampling should be able to clear up any misunderstandings.

Call your home states Attorney Generals Office and ask the same question, if anyone would know they would.

Thanks Gman, I was hoping you would chime in. I've asked several different LEO's I know and get varying answers.

Here is the answer I got from Florida's Attorney generals office:
I've followed every link and can't get a straight answer from anyone.

" Florida Attorney General Bill McCollum has received your email and he asked that I respond.

Additionally, the Florida Department of Agriculture and Consumer Services (DACS), Division of Licensing, is the state agency assigned responsibility for the issuance of Concealed Weapon or Firearm Licenses in accordance with Section 790.06, Florida Statutes. You may reach this office at:

Otherwise, please address any specific legal questions to a private attorney. The Florida Bar offers a Lawyer Referral Service which you may contact toll-free at (800) 342-8060.

Thank you for contacting Attorney General McCollum's Office. I hope this proves helpful. If you would like to keep current with news on Attorney General McCollum's efforts to fight fraud please follow this link and subscribe to the Attorney General's weekly and monthly electronic

All that time and effort avoiding a question that coulsd have just been answered with a Yes or NO!

I will guarentee you that if you had been arrested for carrying in that configuration they could have given you an answer!

If you have a ccw permit, and your state REQUIRES that the gun be concealed, drape a bnadana over it. If it can not or does not require concealment leave it as it is.

I live in an open carry area. Visible is legal, concealed only with a permit.

Keep a old ball cap in the front seat and just drop the cap over the bersa if or when you get pulled over.

Cover it with a cap or a small bath towel. And keep asking.

Where I live that would be perfectly legal, but you need specific Fl open carry law in vehicle information.
